Terms of Service
These terms govern the use of Lemus System, the web and mobile platform operated by Lemus Construction, Inc. ("Lemus Construction", "we", "us") at lemussystem.com and in its related apps, and the text message program described in section 2. By using the platform or agreeing to receive text messages, you accept these terms. These terms also serve as the end-user license agreement for the platform.
1. What the platform is
Lemus System is the internal operations platform of Lemus Construction. It is used by our employees and subcontractors, and by the customers, property managers, association representatives and homeowners we work with, to request service, schedule inspections, review and sign proposals and change orders, receive invoices and track the work we perform. It is not a public marketplace and we may restrict or end access at our discretion.
2. Text message program ("Lemus Construction Job Updates")
Program description. When you opt in, Lemus Construction sends job-related text messages to the mobile number you provided: appointment and inspection reminders, notices that a proposal, change order or invoice is ready, replies to your service requests, and account notices. This program does not send marketing or promotional messages.
How you opt in. By checking the consent box on our web form, by telling a Lemus Construction employee in person or by phone that you agree to receive texts, or by replying to a message we send you with an opt-in keyword. Consent is not a condition of buying any goods or services.
Message frequency. Message frequency varies by job activity, up to 10 messages per week.
Message and data rates may apply.
To stop: reply STOP to any message. You will receive one confirmation text and no further messages unless you opt in again.

Carriers are not liable for any delayed or undelivered messages.
Our Privacy Policy explains how we handle your mobile number and consent records. Your opt-in data is never shared with third parties for marketing.
3. Accounts and access
- Employees and subcontractors sign in with the accounts Lemus Construction issues to them and must keep their sign-in details confidential.
- Customers and homeowners receive secure links or accounts to view and sign their own documents. Do not forward a signing link to anyone else.
- You are responsible for activity under your account and must tell us promptly if you believe it has been misused.
4. Electronic documents and signatures
Proposals, change orders and other documents may be provided and signed electronically. By typing your name and confirming, you agree that your electronic signature has the same effect as a handwritten one, that you can receive and keep the electronic records we provide, and that you may request a paper copy from us at any time. You may withdraw your consent to electronic records by contacting us; doing so does not affect documents already signed.
5. Acceptable use
You may use the platform only for its intended purpose and in compliance with the law. You may not attempt to access other users' records, interfere with the platform, copy or reverse-engineer its software, or use it to send unlawful, abusive or misleading content.
6. Our content and software
The platform, its software, design and content are owned by Lemus Construction or its licensors. We grant you a limited, revocable, non-transferable license to use the platform's web and mobile applications for the purposes above. Documents concerning your own property or job remain yours to keep.
7. Third-party services
The platform relies on third-party services for hosting, messaging, email, mapping, weather data and accounting. Those services have their own terms, and we are not responsible for their availability. Invoices and payments are recorded in QuickBooks Online.
8. Disclaimers and limitation of liability
The platform is provided "as is". We do our best to keep it available and accurate, but we do not guarantee uninterrupted service or that every message will be delivered. To the fullest extent permitted by law, Lemus Construction is not liable for indirect, incidental or consequential damages arising from use of the platform or the text message program. Nothing in these terms limits the warranties and obligations in the written contract for your construction work, which govern that work.
9. Changes and termination
We may update these terms by posting a new version here with a new effective date. Continued use after a change means you accept it. We may suspend or end access to the platform at any time.
10. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules.
